MGMA Comments to HHS on Proposed Policies Overhauling the Health IT Certification Program

On February 27, 2026, MGMA submitted comments to the Department of Health and Human Services (HHS) Assistant Secretary for Technology Policy/Office of the National Coordinator for Health IT, urging careful review, phased implementation, and stability for medical groups as regulators consider removing 34 certification criteria to promote innovation and Fast Healthcare Interoperability Resources (FHIR) adoption. The proposed rule would significantly change required capabilities and testing standards for certified electronic health records (EHRs) that practices rely on for documentation, information exchange, reporting, compliance, and daily operations. MGMA commented that these policies could disrupt workflows and potentially shift new technical and financial burdens onto practices.

CMS Announces Efforts to Address Healthcare Fraud 
The Centers for Medicare & Medicaid Services (CMS) announced new steps to address fraud in Medicare and Medicaid. The agency issued a six-month nationwide moratorium on new Medicare enrollment for certain Durable Medical Equipment, Prosthetics, Orthotics, and Supplies (DMEPOS) medical supply companies. CMS also announced the deferral of federal Medicaid funds to Minnesota due to fraud concerns and issued a request for information on potential future regulations to address fraud prevention.

As artificial intelligence (AI) adoption and use by medical groups grow, so does policymakers' interest and engagement as they focus on critical issues such as innovation, guardrails, and potential new legislation. As outlined in our 2026 position paper, MGMA remains committed to ensuring that federal policies support the safe development and use of AI tools to improve operational efficiency for medical groups.
